At a regular meeting of the Township Board of the Township of Weesaw, held in the Township Hall, 13518 State Street, New Troy, within the Township, on the 20th day of October, 2010 at 8:15 p.m.

 

            PRESENT: Wanda Green, Irene Oman, Jack Jones and Melodie Culverhouse

            ABSENT:     Jane Tackitt

 

The following ordinance was offered by Member Melodie Culverhouse and seconded by Member Wanda Green.

 

Ordinance No. 5-2010

 

Ordinance No. 5 – Repealed

Curfew for Children

 

Public Act 41 of 1960, MCL 722.751 – 722.753, as amended and made effective August 17, 1960 and MCL 750.145 of Public Act 328 of 1931 as amended and made effective September 18, 1931, as follows, are hereby adopted by reference.

 

722.751 Curfew for children under 12 years old.

            Sec. 1.  No minor under the age of 12 years shall loiter, idle or congregate in or on any public street, highway, alley or park between the hours of 10 o’clock p.m. and 6 o’clock am., unless the minor is accompanied by a parent or guardian, or some adult delegated by the parent or guardian to accompany the child.

 

722.752 Curfew for minors under age 16.

            Sec. 2.  A minor under the age of 16 years shall not loiter, idle or congregate in or on any public street, highway, alley or park between the hours of 12 midnight and 6 a.m., immediately following, except where the minor is accompanied by a parent or guardian, or an adult delegated by the parent or guardian to accompany the minor, or where the minor is upon an errand or other legitimate business directed by his parent or guardian.

 

722.753 Aiding underage children to violate law; misdemeanor.

 

            Sec. 3.  Any person of the age of 16 years or over assisting, aiding, abetting, allowing, permitting or encouraging any minor under the age of 16 years to violate the provisions of sections 1 and 2 hereof is guilty of a misdemeanor.

 

750.145 Minor; contributing to neglect or delinquency.

            Sec. 145.  Contributing to neglect or delinquency of children – Any person who shall by any act, or by any word, encourage, contribute toward, cause or tend to cause any minor child under the age of 17 years to become neglected or delinquent so as to come or tend to come under the jurisdiction of the juvenile division of the probate court, as defined in section 2 or chapter 12a of Act No. 288 of the Public Acts of 1939, as added by Act No. 54 of the Public Acts of the First Extra Session of 1944, and any amendments thereto, whether or not such child shall in fact by adjudicated a ward of the probate court, shall be guilty of a misdemeanor.
